I. Scope of Agreement

1.1 This Chroma Spark User Agreement (hereinafter referred to as the "Agreement") is a legal agreement between you (the "User") and the developer of Chroma Spark (hereinafter referred to as "we," "us," or the "Developer") regarding the download, installation, and use of the Chroma Spark game (the "Game") and related services.

1.2 By downloading, installing, or launching the Game through app distribution platforms (including but not limited to Apple App Store, Google Play, and other platforms), you acknowledge that you have fully read, understood, and agreed to all terms of this Agreement and the accompanying Privacy Policy.

1.3 If you do not agree to any part of this Agreement, please immediately cease using the Game. If platform rules or applicable laws require confirmation of updated versions before continued use, you must complete such confirmation; otherwise, you may not be able to continue using the Game.

1.4 We reserve the right to amend this Agreement from time to time. The updated version shall become effective upon publication within the Game or on the official website. We recommend that you review the latest version regularly.

1.5 We reserve the right, based on operational needs, to modify, suspend, or terminate all or part of the Game services at any time. We may also restrict or terminate your access to the Game at our sole discretion without prior notice.

II. Access to and Use of Services

2.1 You are responsible for any network communication fees and related equipment costs incurred in accessing and using the Services.

2.2 By using the Services, you confirm that you are at least 13 years old. If you are between 13 and 18 years old, you must use the Services only after your legal guardian has read, understood, and agreed to this Agreement.

2.3 You assume all risks arising from downloading, installing, and using the Game.

III. Account and Data Management

3.1 The Game is a casual game that does not require account registration.

3.2 Game data is primarily stored locally on your device. If you uninstall the Game, clear cache, or change devices, your game progress may be lost. To the maximum extent permitted by law, we shall not be liable for such loss.

3.3 iCloud Backup Function (iOS Devices Only): You may choose to use Apple's iCloud service to back up your game progress. This feature is independently operated by Apple, and data management is subject to Apple's iCloud terms and policies.

IV. Fees and Virtual Items

4.1 In-game virtual currency (such as coins, diamonds, etc.) may only be obtained through official channels. We reserve the right to remove any virtual currency or items obtained through unauthorized, illegal, or improper means without prior notice.

4.2 Virtual currency and items may only be used within the Game and may not be exchanged for legal tender or physical goods, nor may they be transferred or traded.

4.3 We reserve the right, upon reasonable notice, to adjust the types, pricing, or functions of virtual currency and items.

V. User Conduct

5.1 During your use of the Services, you shall not infringe upon the lawful rights and interests of any third party and must comply with all applicable laws and regulations.

5.2 You agree to observe public order and good morals and comply with relevant codes of conduct. In the event of any violation of this Agreement, we reserve the right to take measures including, but not limited to, restricting or banning accounts.

5.3 Any form of cheating is strictly prohibited, including but not limited to using unauthorized software, exploiting bugs, interfering with service operations, or infringing intellectual property rights.

VI. Intellectual Property

6.1 All intellectual property rights contained in the Game (including but not limited to source code, object code, documentation, art assets, character designs, interface layouts, etc.) are owned by the Developer. Without our prior written permission, no entity or individual may copy, distribute, or use such content in any manner.

VII. Disclaimer

7.1 The Game is provided on an "as is" and "as available" basis. We make no express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 We shall not be liable for any losses caused by force majeure events, third-party service issues, or your improper use of the Game.

VIII. Limitation of Liability

8.1 To the maximum extent permitted by law, we shall not be liable for any indirect, consequential, punitive, or incidental damages arising from the use of or inability to use the Services.

IX. Governing Law and Dispute Resolution

9.1 The formation, validity, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China.

X. Severability

10.1 If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be removed, but the remaining provisions shall remain in full force and effect.

XI. Assignment

11.1 We may assign our rights and obligations under this Agreement to affiliates or acquirers without your consent. You may not assign any of your rights or obligations under this Agreement without our prior written consent.
